Kelly Katherine Babineau is a licensed attorney admitted to practice law in the State of California. She was admitted to the California State Bar in 1997. Her license is currently in active status. Ms. Babineau is the principal attorney at The Law Office of Kelly Babineau, a law firm located in Sacramento, California. She has been practicing law for over 28 years, serving clients throughout the Sacramento area and surrounding regions.
Ms. Babineau earned her Juris Doctor degree from the University of the Pacific, McGeorge School of Law, where she graduated in 1997. Prior to law school, she completed her undergraduate education at San Francisco State University, receiving a Bachelor of Arts degree in Women's Studies in 1993. During her time at McGeorge School of Law, she was recognized with membership in the Traynor Honor Society, an honor society for top law students.
Ms. Babineau concentrates her practice in the areas of criminal defense, including appeals and appellate work, civil appeals, and federal appeals. She represents individuals in matters involving drug crimes, expungement, fraud, gun crimes, internet crimes, sex crimes, theft, and violent crimes. Her practice encompasses all stages of litigation, including initial case evaluation, discovery, mediation, settlement negotiations, and trial proceedings in both state and federal courts.
Throughout her career, Ms. Babineau has handled cases in the Superior Court of California for the County of Sacramento, the United States District Court for the Eastern District of California, and the United States Court of Appeals for the Ninth Circuit. She has also appeared before the California Court of Appeal on multiple occasions. Prior to founding her own firm, she worked as an associate at Rothschild, Wishek & Sands from 2000 to 2002 and served as an Assistant Public Defender at the Sacramento County Public Defender’s Office from 1997 to 2000. In 2023, she was appointed by Governor Gavin Newsom to serve as a Judge in the Nevada County Superior Court, filling the vacancy created by the retirement of Judge Thomas M. Anderson.
Ms. Babineau is an active member of the Sacramento County Bar Association and the California State Bar Association. She holds membership in the National Association of Criminal Defense Lawyers (NACDL) and the California Public Defenders Association. She is also a member of the Women Lawyers of Sacramento, where she has served as Treasurer since 2012. Ms. Babineau is fluent in English and has been recognized for her contributions to the legal community, including being named a Super Lawyer in 2018 and receiving the "Best of the Bar" award from the Sacramento Business Journal in 2015.
